if a contractor, subcontractor, or even an independent contractor, violates the construction code, the board may order the contractor to pay restitution to the owner, or the contractor may be ordered to reimburse the owner for the cost of replacing the work or repairing the building. the board may also revoke or suspend the contractors or subcontractors license. in addition, the board may order the contractor or subcontractor to pay a civil penalty not to exceed $5,000, which is in addition to the restitution or cost of replacement or repair. for further information, the licensee or contractor should refer to the florida administrative code. the licensee or contractor may, however, recover actual damages from the contractor and owner, or the subcontractor as the case may be. the contractor or subcontractor may be liable for the cost of labor and materials used in remedying the violation, as well as for court costs and attorneys fees. the state and local governments are not liable for any damages or costs, except for the following:
